Khidma – Terms of Service

Welcome to Khidma ("Company", "we", "our", "us"). By using our mobile application, website, or services ("Platform"), you ("User", "you") agree to these Terms of Service. If you do not agree, you must stop using the Platform immediately.
1. Nature of Services
Khidma provides access to:
- Islamic scholars / Alims for spiritual guidance
- Non-clinical counselors for emotional and personal support
Khidma does NOT provide:
- Medical advice
- Psychiatric care
- Therapy or clinical diagnosis
- Emergency or crisis intervention
- Legal or financial advice
All information they provide is opinion-based, religious, spiritual, or general guidance only.
Nothing on Khidma should be considered medical, psychological, or professional advice.
2. No Emergency Services
Khidma is NOT suitable for:
- Suicidal thoughts
- Self-harm intentions
- Violent intentions
- Mental health crises
- Medical emergencies
If you are in danger or considering harming yourself or others, you must immediately contact your local emergency services, hospital, or a suicide prevention hotline.
Khidma does not monitor real-time emergency risk and assumes no responsibility for crisis outcomes.
3. No Liability for Actions Taken Based on Advice
Khidma, its team, its Alims, counselors, and partners:
- Are not responsible for any decisions, actions, or outcomes based on advice or information you receive.
- Do not guarantee accuracy, completeness, or suitability of any guidance.
- Are not liable for emotional, psychological, financial, relational, spiritual, or physical consequences of any advice.
By using Khidma, you agree that:
- You are fully responsible for your own decisions, actions, and life choices.
Khidma cannot be sued, blamed, or held liable for anything you do (or do not do) after receiving guidance on the platform.
4. No Liability for Self-Harm, Suicide, or Harm to Others
To the maximum extent permitted by law:
Khidma, its employees, Alims, counselors, founders, and partners are not liable for:
- Suicide
- Suicide attempts
- Self-harm
- Harm to others
- Mental health deterioration
- Emotional distress
- Any crisis outcome
- Any loss of life or property
This applies even if:
- You previously had a session on Khidma
- You discussed suicidal or harmful thoughts
- You misunderstood or misinterpreted advice
- You believe guidance influenced your actions
- You claim an Alim / counselor told you something that led to harm
You explicitly agree that Khidma is not responsible for your mental or physical wellbeing and cannot be held liable in any situation involving harm or crisis.
5. User Responsibility & Assumption of Risk
By using Khidma, you agree that:
- You understand the platform is not a substitute for professional mental health care.
- You are solely responsible for how you interpret and apply any advice.
- You will not rely on Khidma for medical, psychiatric, or emergency support.
- You will not hold Khidma responsible for your actions, emotions, or decisions.
- You assume all risks associated with using the platform.
6. User Conduct
You agree not to:
- Share false, threatening, abusive, or harmful messages
- Misrepresent your identity
- Harass or intimidate scholars or counselors
- Misuse the platform for crisis intervention
- Seek professional medical or psychiatric treatment here
Khidma may suspend or terminate your account for violations.
7. Accuracy & Reliability of Advisors
Khidma verifies basic identity / credentials of Alims and counselors but:
- Does not guarantee their expertise
- Does not control their opinions
- Is not responsible for their statements
- Does not endorse personal advice or interpretations
Users should independently verify any religious, personal, or practical guidance received.
8. Limitation of Liability (Very Important)
To the fullest extent permitted by law:
- Khidma's total liability for any claim is limited to the amount you paid for the session (if any).
- Khidma is not liable for any indirect, incidental, special, exemplary, or consequential damages.
- Khidma is not liable for loss of life, injury, self-harm, suicide, emotional distress, or damages arising from advice, communication, or platform use.
9. Indemnification (Protects You Legally)
You agree to indemnify and hold harmless Khidma, its founders, employees, partners, scholars, and counselors from all claims, damages, losses, liabilities, and legal fees that arise from:
- Your use of the platform
- Your actions or inactions
- Your reliance on advice
- Any harm you cause to yourself or others
- Any false claims, complaints, or disputes you raise
- Breach of these Terms
This is a legally strong protection for the company.
10. No Recording & No Liability
Since Khidma does not record calls:
- Khidma is not responsible for any "he said / she said" disputes
- Khidma cannot verify every conversation
- Users cannot claim damages based on unverifiable statements
- Scholars' messages may be reviewed only through chat logs
All disputes rely on available data, not user claims.
11. Payment, Refunds & Cancellations
All payments are processed via secure third-party gateways.
Refunds are governed by the Refund Policy.
12. Account Termination
Khidma may suspend or terminate accounts at its discretion for misconduct or safety concerns.
13. Governing Law
These Terms are governed by the laws of India.
Any legal disputes must be handled exclusively in the courts of [Insert City, India].
14. Updates to Terms
Khidma may update these Terms anytime.
Continued use of the platform means you accept the updated Terms.
